La operación vacaciones de verano se complica. Aena ha informado a primera hora de la mañana de este viernes de que debido a una incidencia en el sistema informático se han producido alteraciones en los sistemas y en los aeropuertos de la red en España, lo que ha provocado retrasos. Así lo explicaban en X.

En otras comunicaciones en la misma red social, explicaban que están haciendo los protocolos de facturación y embarque de manera manual y que, poco a poco, en distintos aeródromos se está volviendo a la normalidad. El fallo informático, en principio responsabilidad de Microsoft, afecta a nivel global no solo a los aerorpuertos, sino a todos los sistemas regulados por la compañía, como la Bolsa de Londres, muchas entidades bancarias o la cadena de hipermercados Carrefour, donde, por poner un solo ejemplo, hoy no fue posible utilizar a primera hora de la mañana sus medios de pago.
¿A qué tienen derecho los usuarios?
Como siempre que hay problemas o retrasos en los vuelos, surge la pregunta de cómo va a afectar a los viajeros. Como explican los expertos de Airhelp, empresa dedicada a gestionar reclamaciones aéreas, siempre va a depender de dos variables: quién es responsable del fallo, y la seguridad y bienestar de los pasajeros.
En este caso concreto, al no ser responsabilidad de AENA ni de las compañías aéreas, no habría derecho a una compensación económica, no siquiera si se ha cancelado un vuelo o el retraso es considerable (más de tres horas).
Sin embargo, atender a los pasajeros a lo largo de cualquier incidencia, incluido el fallo informático de Microsoft de hoy, sí es responsabilidad de la aerolínea. Las compañías aéreas tienen obligación de cubrir las necesidades básicas y otras incidencias.
- Necesidades básicas: la aerolínea está obligada a proporcionar agua, comida y acceso a telecomuniciones a partir de las dos horas de retraso.
- Transporte: la aerolínea debe proporcionar un vuelo o transporte alternativo a destino. Si el pasajero decide no volar, la compañía aérea debe reembolsar el precio del billete.
- Pernoctaciones: si el retraso, la cancelación o el cambio de vuelo obliga a pernoctar al pasajero, la aerolínea debe ofrecer una habitación de hotel y desplazamiento hasta el mismo, haciéndose cargo de los gastos.
Por último, los expertos de Airhelp señalan que es posible que las compañías aéreas, a su vez, reclamen estos gastos a Microsoft como empresa final responsable. Estas reclamaciones entre compañías son habituales, aunque no se ha confirmado que ninguna compañía aérea afectada vaya a ejercer este tipo de acciones.
¿Qué recomienda la OCU?
Ante cualquier incidencia en un aeropuerto, la OCU recomienda es presentar una reclamación tanto a la compañía aérea como a AENA. Lo mejor es hacerlo en uno de los mostradores del aeropuerto para que se gestione con agilidad. También se puede presentar en el formulario web que tienen habilitado para presentar reclamaciones o bien por correo ordinario. Los pasajeros también podrán exigir las compensaciones establecidas en el Reglamento Europeo, además de una indemnización por los daños y perjuicios sufridos que afecten a otros servicios asociados al viaje que se haya pagado, si incluye transporte y alojamiento, como pueden ser otro vuelo posterior o el alojamiento en un hotel.
